This week, a federal court of appeals declared that "democracies die behind closed doors" and demanded that Attorney General John Ashcroft open up the immigration hearings for suspects connected to Sept. 11 roundups. But wherever the courts open one door, Ashcroft and the Bush administration manage to close another. And so we find ourselves in peril of losing the right to search warrants granted by real judges in real courts, as the attorney general again attempts to drag the Constitution into dark caverns and windowless towers.

A bill that would encourage sales of more diesel cars, a move staunchly supported by the auto industry but rejected by environmental groups, is expected to be introduced by U.S. Representative John Dingell, D-Mich., a newspaper reported Wednesday.

Industry executives say modern diesel engines are much cleaner and quieter than those of the 1970s and can boost fuel economy and reduce emissions in a relatively easy way, the New York Times reported.

Nortel Networks Corp. shares fell at the start of trading on Wednesday after the struggling telecom equipment maker cut its third-quarter revenue target and said it would ax about 7,000 jobs.

"If this $2.6 billion break-even point is the bottom, I still don't expect a rapid level of growth or much growth from this point sequentially. We're looking at a very weak environment," said Shayna Malnak, an analyst with Williams Capital Group in New York, who has the stock rated "sell."

Markets like these are enough to drive most investors to drink. That's what a new fund is hoping, anyway.

The Vice Fund, the latest brainchild of mutual fund broker Mutuals.com, invests in a wide swath of "sin" stocks. After all, the theory goes, such stocks are recession-proof -- no matter how bad the economy gets, people will always drink, smoke, gamble and well, you get the idea.

The fund will focus primarily on four areas: alcohol, tobacco, gambling, and aerospace and defense, according to portfolio co-manager Dan Ahrens. At least 90% of the fund's assets will be invested in these four areas.

Main Street investors can now get a taste of living large -- just like the high rollers of the investment world.

At least that's what veteran fund executive Steve Samson says about his new mutual fund that looks and feels like a hedge fund.

During the market's recent 2-1/2-year slump, hedge funds -- those loosely regulated investment pools long reserved for the wealthy -- beat out most other investment vehicles with huge returns.

"We are not promising the world, but we are promising consistent, absolute positive returns over market cycles," says Samson, principal at Alternative Investment Partners LLC in Chappaqua, New York.
