"That's the argument of flexibility and it goes something like this: The Constitution is over 200 years old and societies change. It has to change with society, like a living organism, or it will become brittle and break." "But you would have to be an idiot to believe that," Scalia said. "The Constitution is not a living organism, it is a legal document. It says something and doesn't say other things."
Scalia completely misses the boat on this. He seems to think that this is an either/or proposition. It is not. The founding fathers did not consider wiretaps when they were writing it, and the Constitution says nothing about them, so there is no "originalist" opinion on the matter. Yet they have consistently been ruled on under the search and seizure clause. I also suppose this means Scalia is pro-slavery since that's in there too. Sorry Tony, your intelectual position doesn't hold water. Scalia Dismisses 'Living Constitution' - Yahoo! News |

We can't think of a president who has gone to the American people more often than George W. Bush has to ask them to forget about things like democracy, judicial process and the balance of powers — and just trust him. We also can't think of a president who has deserved that trust less.

Later, after the war began in 2003, Cheney authorized Libby to release additional classified information, including details of the NIE, to defend the administration's use of prewar intelligence in making the case for war.
It's either ok to leak or it's not ok to leak. With these guys classifying more crap than the last couple residents of the oval office combined, that Scott McClellan can even tell time is amazing. NATIONAL JOURNAL: Cheney 'Authorized' Libby to Leak Classified Information (02/09/2006) |

Specifically, the statement said that the administration would interpret the amendment "in a manner consistent with the constitutional authority of the president to supervise the unitary executive branch and as commander in chief and consistent with the constitutional limitations on judicial power."

Gonzales said that while FISA prohibits eavesdropping without court approval, it makes an exception where Congress "otherwise authorizes." That authorization, he said, was implicit in the authorization for the use of military force in Afghanistan following the Sept. 11 attacks.
If someone would like to explain how NSA doing wiretaps is use of military force, this argument would have a better chance of floating. Bush Defends Eavesdropping Program |
