Apple has filed a motion in the District Court for the Northern District of California asking the judge to reject Samsung's request. According to the filing, Apple says, Samsung's request "is not a good faith attempt to obtain information needed to defend against a preliminary injunction". "Rather, it is a transparent and improper attempt to harass Apple by demanding extremely sensitive trade secrets that have no relevance to Apple's infringement claims, or to Samsung's defences to a preliminary injunction," according to the documents. Last month, Samsung had sought a court order to force Apple to disclose iPhone and iPad models under development. The Korean smartphone maker said it needs the information to defend against allegations it copied Apple's products. According to documents filed on May 27 by Samsung in San Jose, California federal court, Samsung must be allowed to see the final versions of the next-generation iPhone and iPad, which may be known as iPhone 5 and iPad 3, to "evaluate whether a likelihood of confusion exists" between new Samsung and Apple products that will probably go on sale about the same time. Samsung's demand was part of the rivalry between the two companies which started in April this year when Apple alleged that Samsung Galaxy products "slavishly" copied iPad and iPhone technology and design. Apple filed suit against Samsung in San Francisco alleging that the South Korean company copied its smartphones and tablet computers. Apple's lawsuit claimed Samsung's mobile phones and Galaxy Tab imitated the iPhone and iPad. Samsung too retaliated with patent lawsuits against Apple in South Korea, Japan and Germany, involving infringements of up to five patents.
