I'm fairly certain that this law only applies to commercial email. When you forward to a friend, you are sending an email through my system. I do tack a line of text at the bottom that might be seen as an ad. Many free email services do the same. I think this is not what this law intended to ban, even if this would turn the email into a "commercial" email under their definition. Its problematic in that it could generate a lawsuit, but if well defended that lawsuit would probably fail.
