I know this is a bullshit post, but do you think cases like this could be used as legal precedent for others to escape conviction of DUI, drug possession, etc? |

you spelled it correctly. To answer your specific question, no. Precedent is only set when a judge issues an opinion on a specific point of law at issue in a case. And in the case of lower courts, rulings are advisory only to other courts, and oftentimes not even precedential in the same court. Here, the DA is deciding whether to decline pressing charges, which is not related to judgment of the Court. The only precedent I see is the same ol same ol - there's no justice in America as long as there is such a big difference between rich, and poor. Rich= good lawyers, go home. Poor= pay fine after fine, and in jail. |
