I think the Fatality is the section indicating that SCO is in breach of it's fiduciary duty. They owe what is likely to turn out to be a metric fucktonne of money that they ain't gonna get from the IBM case, nor raise in a bake sale.

If the employees are smart, they've already looted the company of anything of value. I would imagine that you could say the same of the top suits, but, well, they're gonna get sued.
