Yeah. I'm unhappy with this result but because I'm not a lawyer I have no leg to stand on. But this is the text to Article 1 of the Constitution:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

No where does it say that you can't throw a reporter in jail for failure to give a deposition. It was just sort of a "yeah we don't do that" sorta thing.
